Terms of cancellation

ARTICLE 1 - SCOPE OF APPLICATION

It is hereby specified that these conditions govern the online sale on www.bourgogne-evasion.fr and www.burgundybiketour.com of guided or self-guided bicycle tours, but also walking tours and all other activities offered by Bourgogne Evasion / Active Tours.

These conditions apply to the exclusion of all other conditions.

ARTICLE 2 - ACCEPTANCE OF THESE TERMS AND CONDITIONS

The fact that an Internet user confirms his/her order on www.bourgogne-evasion.fr and www.burgundybiketour.com by clicking on the ORDER button implies full and complete acceptance of these general terms and conditions of sale in their entirety.

ARTICLE 3 - PRICES

3.1 - The prices of our tours and other products are indicated in euros, all taxes included.

3.2 - All orders, whatever their origin, are payable in euros.

3.3 - Active Tours / Bourgogne Evasion reserves the right to modify its prices at any time, the products and services being invoiced on the basis of the rates in force at the time of the registration of the orders, subject to availability.

3.4 - Active Tours / Bourgogne Evasion reserves the right to modify the content of the programmes in order to constantly improve their quality, but also to respect the safety rules for the clients and the guides.

ARTICLE 4 - ORDERING

The customer places his order on line on the website www.bourgogne-evasion.fr and www.burgundybiketour.com. It can only be registered on the site if the customer is clearly identified by completing the online order form. Any order implies acceptance of these general terms and conditions of sale.

The validation of the order is done after acceptance of the payment. (online for a payment by credit card, upon receipt of the cheque for an order by bank cheque or upon receipt of the bank transfer for an order by bank transfer)

Provided that the customer has entered his e-mail correctly, he will receive an e-mail confirming the order.

Active Tours / Bourgogne Evasion therefore invites the customer to consult his e-mail address. Confirmed orders are processed, after validated payment, every working day from 9am to 5pm. In case of incident preventing the processing of the customer's order, it will be cancelled.

ARTICLE 5 - AVAILABILITY

We can accommodate a limited number of people on our bike tours.

From 2 to 16 people for a full day bike tour. And from 2 to 22 people for a half day bike tour.

This limited number of places does not allow us to welcome other people than the registered participants.

For everyone's comfort, animals are not allowed.

Availability is mentioned on our website.

Orders are processed on a first come first served basis, only those orders for which payment has been received will be taken into account.

Departures of our tours are guaranteed from 2 people registered. If you register alone and you are the first person to register, we will come back to you to validate your reservation after the next person has registered. If necessary, we will offer you another date or a refund.

ARTICLE 6 - GIFT VOUCHERS

Gift vouchers are valid until the end of the tourist season (31 October) of the current year or, in the case of a purchase at the end of the year, until the end of the following season, unless otherwise stated on the voucher itself, within the limit of available places, and for the date mentioned. The expiry date is mentioned on the cheque itself.

The validation of a gift voucher can be done online on our website www.bourgogne-evasion.fr, or by email at : info@active-tours.fr.

The order number and the gift voucher number (indicated on the gift voucher itself) are required to validate any reservation.

Once a date has been booked, any cancellation of a booking will incur a cancellation fee as per the scale set out in article 13. The gift voucher will be reinstated after receipt of the payment of the cancellation fee by bank cheque.

If you cannot come to the venue on the day, you can give the gift voucher to an adult of your choice.

If the beneficiary of a gift voucher is unable to take part in the bike tour offered within the period of validity, it is imperative to inform us by email.

Gift vouchers cannot be exchanged for money, in any form whatsoever, in whole or in part. They cannot be replaced if their validity period expires. They may be transferred to a third party of legal age.

Gift vouchers are valid according to the dates mentioned above, they cannot be used outside the tourist period (between 1 April and 31 October) unless otherwise stated. The gift vouchers for the bike and wine day and the bike and wine half day cannot be used on Sundays.

ARTICLE 7 - PAYMENT

The payment of your order is made :

- by credit card: The customer can pay his purchases on line by credit card (Eurocard, Visa, Carte Bleue, Mastercard). Active Tours / Bourgogne Evasion has selected the secure payment solution of a major bank: La Caisse d'Epargne. At the time of the order, when the customer has to enter or communicate his card number and its validity date, he will not be on the Bourgogne Evasion website but on a Caisse d'Epargne website. The given numbers never transit on the website and are never known nor kept by Active Tours / Bourgogne Evasion.

After verification and agreement of the Caisse d'Epargne, you will automatically return to the Bourgogne Evasion or BurgundyBikeTour.com website to continue your purchases in complete security.

- By cheque: this must be issued by a bank domiciled in metropolitan France or Monaco. Only cheques made out in euros are accepted. The cheque is cashed on receipt.

Cheques made out to ACTIVE TOURS should be sent to ACTIVE TOURS, Parc de la Bouzaise, Allée Dr Bouley, 21200 Beaune.

The reservation with the payment by cheque will be effective only after the cheque has been received by Active Tours. The said reservation will be maintained 5 days after the date of the online request. After this time your order will no longer be guaranteed.

Upon receipt of this payment a confirmation will be sent to the email address indicated in your booking form.

ARTICLE 8 - DELIVERY

The invoice is sent by e-mail to the address indicated at the time of registration, a few minutes after validating the registration. This is the "order summary".

The delivery of gift vouchers is dematerialised and is done by sending an e-mail containing a file to be printed. The delivery time of a gift voucher is approximately 24 hours following the payment agreement by the Caisse d'Epargne. (or the reception of the payment by cheque).

ARTICLE 9 - RIGHT TO ERROR OR MODIFICATION OF RESERVATION

For activities and tours of less than 24 hours:

9.1 - You have changed your mind, you have made a mistake. We give you the possibility to cancel your order simply and free of charge (except for bank charges equal to the fixed sum of 3€/order) during 7 days, except for tours ordered less than 15 days before the chosen date.

9.2 - Your cancellation must be sent by email to info@active-tours.fr. The date of sending the email will be taken as proof.

9.3 - Refunds will be made within 14 days of your request. Refunds will be made to the credit card account used for the order or by bank transfer to your account, for which you will have sent the details to Active Tours / Bourgogne Evasion.

9.4 - If you wish to modify the order, less than 15 days before the chosen date, your request must be sent to us by e-mail. If the new date is available we will make the modification. This modification of the reservation will be charged 10€/person/tour.

For stays and activities lasting more than 24 hours:

For a modification of a confirmed reservation, there is a reservation modification fee based on : 40 Euros per booking and per modification.

ARTICLE 11 - PERSONAL DATA

The information collected on the Client is subject to computer processing by the ACTIVE TOURS agency and is essential for the processing of his/her order.
This information and personal data are also kept for security purposes, in order to comply with legal and regulatory obligations. It will be kept for as long as necessary for the execution of orders and any guarantees that may apply at the end of these orders.

ACTIVE TOURS undertakes to respect and protect the confidentiality of the personal data processed. The person in charge of data processing at ACTIVE TOURS is Mrs Catherine Brossais.
Within ACTIVE TOURS, access to personal data will be limited to employees authorised to process them by virtue of their functions. The ACTIVE TOURS agency may, for the purposes of the holiday, be required to transmit this data to its service providers (hoteliers, transporters, etc.), some of whom are located outside the European Union.

In accordance with the law n° 78-17 of 6 January 1978 relating to information technology, files and freedoms, as modified by the law n° 2004-801 of 6 August 2004, and by the European Regulation n°2016/.679, the Customer has a right of access, rectification, deletion and portability of data concerning him/her, as well as the right to object to the processing for legitimate reasons, which he/she may exercise by contacting the data controller at the postal or email address mentioned below, enclosing valid proof of his/her identity.

In the event of a complaint, the customer may contact the Commission Nationale de l'Informatique et des Libertés (CNIL).

ARTICLE 12 - RULES OF GOOD CONDUCT, LOSS AND DETERIORATION OF EQUIPMENT:

Each participant undertakes to be fit to cycle on the public highway in such a way as not to constitute a danger to himself or herself or to others. To ride in accordance with the highway code and not to obstruct traffic.

Burgundy Evasion / Active Tours organises wine tasting during these activities. Each participant commits himself to remain in control of his actions, in no case the consumption of alcohol is recommended or encouraged by ACTIVE TOURS / Bourgogne Evasion.

Wearing a helmet during the guided bike tours is mandatory and will be imposed by the guide. If for any reason the helmet is not worn, Active Tours is not responsible for any accident.

You will be asked to respect the equipment provided. In the event of damage due to misuse, you may be required to reimburse the costs incurred.

If the bike is damaged beyond repair (as determined by ACTIVE TOURS), the client will pay €2500 for an electric bike, €800 for a VTC and €1250 for a road bike.

If significant damage to the equipment occurs, the participant or the hirer undertakes to reimburse the hirer for the amount of the damage.



Notes on repair rates:

- Pronounced deformation of the rim 30 €.

- Premature tyre wear € 10

- Damage or loss of helmet 30 €.

- Damage to the electric bike meter € 95

- Damage to a brake lever €30

- Damage to the bike frame 10€ to 600€ if the frame has to be replaced

- Damage to a handle 10€.

- Loss or damage to a Bosh battery €600

- Loss or damage to a front bag 50€ and a rear bag 30€.

- Loss of a pump or anti-theft device 10€.

- Damage to the rear derailleur 50€.

Theft or loss

In case of loss or theft, the hirer agrees to pay the value of the bike.
That is 3300 Euros/Scott electric mountain bike; 800 Euros/Scott bike; 2500€/electric bike and 1250E/road bike

ARTICLE 13 - RESPECTING THE TIMETABLE OF THE GUIDED TOURS:

Each tour and excursion is planned with precise schedules. The participants commit themselves to respect the departure times, an arrival 5 minutes in advance is recommended. In case of late arrival of participants, Active Tours is not liable for any compensation if the tour has already started. It is the responsibility of the participants to inform us in case of delay. A delay of 15 minutes is acceptable, after that the guide will decide whether or not to start the tour.

For private tours, in case of delay of the group, Active Tours will accept a delay of 15 minutes. Beyond that, a surcharge of 10€ per 20 minutes of delay will be applied and claimed from the participants.

The guide will be in charge of ensuring that the end of the activity is respected. However, it is possible that the activity is delayed for reasons beyond the guide's control, and clients agree to inform the guide at the beginning of the tour if there is a time imperative at the end of the activity.

ARTICLE 14 - CANCELLATION CONDITIONS:

In case of cancellation by the client for activities and tours shorter than 24 hours:

-From the date of booking until 7 days before the date of the tour: there are no cancellation fees and the total price will be fully refunded to the client, except for bank charges (flat fee of 3€/order).

-Between 7 days and 2 days before the tour date - cancellation fee: 50% of the total price.

-Less than 48 hours before the start of the tour, the total price is due and no refund is possible.

In case of cancellation by the client for stays and activities lasting more than 24 hours the cancellation fee schedule is as follows:

Before 42 days: cancellation fee: 40€.

Between 42 and 30 days before: 200€.

Between 30 and 21 days before: 25% of the cost of the trip

Between 21 and 14 days before: 50% of the cost of the trip

Between 14 and 0 days before: 100% of the cost of the trip

ARTICLE 15 - CANCELLATION BY ACTIVE TOURS:

Active Tours / Bourgogne Evasion is committed to providing the service. If for security or logistical reasons the service has to be cancelled, the totality of the service will be reimbursed, this decision can only be taken by Active Tours / Bourgogne Evasion.

In case of impossibility to provide the service, Active Tours commits itself to reimburse the totality of the order as soon as possible, either by bank transfer or by cheque.

Weather conditions may be a factor in the cancellation of the service. An Orange or Red alert from Météo France may be one of the reasons for cancellation. However, the guide remains the sole decision-maker as to how the activity will be carried out.

ARTICLE 16 - CONDITIONS OF USE OF ELECTRIC SCOOTERS

- The renter of the electric scooter must respect the highway code in the same way as a pedestrian. The electric scooter can be used

only on cycle tracks, paths, and tolerated on the road. The maximum speed allowed is 25 km/h

- When passing any other vehicle, motorised or not, you must switch off the assistance

- The recommended minimum age for riding is 12 years, and a minimum height of 1.50 m. The presence of a

- The electric scooter is an off-road activity with a high risk of falling. You agree to practice this activity, fully aware of the possible risks involved.

- You certify that you have sufficient physical and technical skills to practice this activity

- Wearing a safety helmet is mandatory

- Closed shoes are compulsory to practice the activity

- Arrival 15 minutes before the scheduled time for presentation, equipment, start-up and testing of the material. Ride

of one hour and a half.

- Each route has been calculated with enough time to enjoy the landscape.

Any delay will be charged 15€ per hour started.

- The hirer will not be held responsible for any damage or loss suffered or caused by the vehicle.

- The hirer is responsible for the rented equipment from the moment he takes possession of it until its

returned.

- We decline any responsibility in case of accident outside the routes planned by Active Tours and E-trott Expérience.

- The hirer certifies that he/she is adequately insured against the risks associated with the rental of a

electric scooter (see multi-risk home insurance).

- The hirer acknowledges by signing this contract that he/she has received the rented electric scooter(s) and the basic equipment in perfect condition

in perfect working order. To this end, an inspection of the equipment will be carried out prior to collection and any remarks will be mentioned in the rental contract. An inspection of the equipment will be made on return. The amount of any damage caused may be claimed on the basis of the following fixed price:

A motor (500€), a display (85€), a wheel (459€), a power cable (15€), a handlebar (56€), a hydraulic brake handle (45€), a backpack (55€), a battery (696€), an acceleration handle (25€), a green handle grip (15€), a camera (500€), a helmet (50€), gloves (20€)

- In the event of non-return of the electric scooter(s) (misappropriation, theft, responsible accident rendering the electric scooter unusable), the hirer's entire responsibility will be engaged and the scooter will be invoiced in full: 3150,00 €,

- Respect a safety distance adapted to your speed between the electric scooters

- In order to preserve the electric motorization and your autonomy, put your foot on the ground in the too strong ascents

- Wait for the whole group at each intersection

- Check your route map or GPS application often to see where you are on the map

- Check your battery indicator so you don't push your way back

- Keep control of your speed and trajectory at all times

- Don't overestimate your ability to ride, be careful
